1. Acceptance of Terms

By downloading, installing, or using Ink Check ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Ink Check is a mobile application that provides:

• AI-powered tattoo healing assessments
• Photo-based tattoo monitoring
• General aftercare guidance and information
• Healing timeline tracking

4. Eligibility

You must be at least 18 years old to use Ink Check. By using the App, you represent that you are at least 18 years of age.

5. User Responsibilities

You agree to:

• Provide accurate information about your tattoo and symptoms
• Use the App only for its intended purpose
• Not use the App as a substitute for professional medical care
• Not upload inappropriate, offensive, or illegal content
• Maintain the security of your device

6. Subscriptions and Payments

6.1 Subscription Plans

Ink Check offers the following auto-renewing subscription plans ("Ink Check Pro"):

• Monthly: Billed monthly
• Annual: Billed once per year

Current pricing is displayed in the app at the time of purchase and may vary by region. Subscriptions provide access to premium features including unlimited checks, full timeline history, and detailed analysis.

6.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment is charged upon confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

6.3 Free Trials

• Free trials may be offered for subscription plans
• If you do not cancel before the trial ends, you will be charged for the subscription
• Unused portions of free trials are forfeited upon purchasing a subscription

6.4 Cancellation

• You may cancel your subscription at any time through your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

6.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's App Store according to their refund policy.

7. Intellectual Property

• The App, including its design, features, content, and AI models, is owned by Ink Check and protected by intellectual property laws
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
• You may not copy, modify, distribute, sell, or lease any part of the App

8. User Content

8.1 Your Photos

• You retain ownership of photos you take using the App
• By using the App, you grant us permission to process your photos through our AI analysis service
• We do not claim ownership of your photos

8.2 Acceptable Use

You agree not to upload content that:

• Is illegal, harmful, or offensive
• Infringes on others' rights
• Contains malware or harmful code
• Is not related to tattoo healing assessment

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI ASSESSMENTS

We do not warrant that:

• The App will be uninterrupted or error-free
• AI assessments will be accurate or complete
• The App will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INK CHECK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages arising from reliance on AI assessments
• Any damages exceeding the amount you paid for the App in the past 12 months

12. Indemnification

You agree to indemnify and hold harmless Ink Check and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last updated" date

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the App
• Is illegal or fraudulent

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ink Check regarding the App.
